TO ALL WIRRAL MPs AND COUNCILLORS

Dear MPs and Councillors,

With regard to mobile phone masts and planning applications / decisions:

Primary question:

An increasing number of residents now rely on active, implantable medical devices, (AIMDs) such as pacemakers, insulin pumps, defibrillators, infusion pumps, ventricular assist systems, cochlear implants, and deep brain or spinal cord stimulators. These life-saving technologies – along with metal implants – are known to be vulnerable to electromagnetic interference (EMI) from radio frequency (RF) emitting infrastructure, including mobile phone masts and 5G transmitters.

The UK Health Security Agency (UKHSA) has acknowledged the risks and advises that users of these devices must avoid exclusion zones around RF emitting infrastructure. However, as you are aware, the locations of these zones are neither defined nor contained within planning documents, and are therefore NOT publicly accessible. There is a resultant lack of clarity which creates a serious risk for people who wear the above medical devices. Children and people with metal / medical implants and individuals with pre-existing health conditions are being unknowingly exposed to harmful levels of radiation.

Here, it was confirmed that a failure to consider the known risks of RF radiation especially in relation to wearers of these devices and other vulnerable individuals constitutes an error in law in the associated planning decisions. This ruling establishes a legal precedent for all councils, which must now be observed.

In light of the UK Health Security Agency’s positive position on exclusion zones for AIMD wearers, and the Court of Appeal’s ruling on Thomas vs. Cheltenham Borough Council, how does Wirral Council intend to fulfil their duty of care towards AIMD wearers, people with metal implants, children, and others at risk of biological harm when considering planning applications?

(The ICNIRP certificate does not account for medical vulnerabilities or cumulative exposures, and no official exclusion zones are currently enforced or made public.)

Supplementary question:

Based on its latest findings, the World Health Organisation has confirmed the cancer risk from RF radiation. The Radiation Research Trust wishes to bring the council’s urgent attention to these latest findings from the WHO’s research on cancer (IARC). Their published research was featured in the Environmental Research 2025:

This comprehensive, systematic review concludes that RF radiation causes cancer in laboratory animals. These findings significantly strengthen IARC’s original 2011 classification of RF radiation as a Group 2B possible human carcinogen. In light of this evidence, many doctors and scientists are now calling for RF radiation to be reclassified as a Group 1 – a known human carcinogen – raising serious concerns over the inadequacy of the existing public exposure limits and the need for the precautionary policy in planning decisions.

How will Wirral Council take this new scientific evidence into account when approving planning applications for phone masts and 5G infrastructure, especially near vulnerable groups such as people living with cancer, cancer survivors, children and residents in schools, care homes, hospitals or private homes? In light of this emerging scientific evidence, will the council update their planning policy to better protect public health?

These questions are primarily addressed to Councillor Stuart Kelly, Chair of the Wirral Planning Committee. A detailed response would be much appreciated. For MPs and non-planning committee councillors they represent essential information.

Once again, I am requesting that Councillor Kelly invites members of the Wirral Residents Association to the next planning committee. An open invitation would provide us with the opportunity to have our viewpoints aired and to publicly lodge questions with our representatives.

Thus far, my requests have been roundly ignored. This repeated failure to respond does not place yourselves or your organisation into a very good light. May I take the opportunity to remind planning committee councillors that they will be made directly liable for any perceived failure?
